  1. PARKING FEES
  • You agree to pay the parking fee displayed at the entrance upon your arrival or departure as we may direct

 

  1. USE OF CARPARK
  • You must comply with all rules or directions displayed in the carpark from time to time and with all relevant laws
  • You must not obstruct other persons or vehicles using the carpark
  • You must not park in any area marked “reserved” or “no parking”
  • You must provide us with your full name and address if asked
  • These rules of use also apply to any passengers and the other users of your vehicle
  • The only vehicles you are authorised to park in the carpark are vehicles which;
  1. a) have a current warrant of fitness and motor vehicle registration
  2. b) are road worthy and able at all times to be driven under their power; and
  3. c) do not represent any danger or risk to other vehicles, persons or the carpark

 

  1. WHAT HAPPENS IF YOU DO NOT COMPLY WITH THESE CONDITIONS?
  • We may keep your vehicle until you pay all costs
  • You will continue to be liable for the parking fee during the period that we retain your vehicle until we recover the costs
  • While your vehicle is retained by us we may clamp it or move it anywhere at your cost
  • If you fail to pay our costs within 30 days we may sell your vehicle to recover the costs

 

  1. YOUR LIABILITY
  • You agree to indemnify us in respect of any claim made against us arising from either;
  1. a) your use of the carpark; or
  2. b) the use of the carpark by anyone else with your authority
  • You also agree to indemnify the owner of the carpark in the same manner if we do not own the carpark ourselves

 

  1. OUR POSITION
  • While we shall take all reasonable care, we cannot guarantee the security of your vehicle
  • Nothing contained in this agreement limits or restricts any statutory right or remedy that may be available to you
  • When you are using the carpark for business purposes, the Consumer Guarantees Act 1993 does not apply
  • We accept no liability for any claim by you or any other person, whether for any loss or damage
  1. a) to you or any other person;
  2. b) to your vehicle or any other vehicle whether resulting from using the carpark or being unable to use the carpark or from our negligence or otherwise

 

  1. WE CAN MOVE YOUR VEHICLE
  • By parking here you authorise us at your cost, to move your vehicle anywhere, even if it is locked
  • We accept no liability for any claim made by you or any other person for any loss or damage caused as a result

 

  1. WHO IS ENTITLED TO TAKE AWAY YOUR VEHICLE?
  • We may deliver your vehicle to any person who produces a carpark ticket issued by us or some other evidence of ownership or entitlement that we determine to be satisfactory to us
  • We may retain your vehicle until we are provided with a carpark ticket issued by us or proof of ownership or entitlement  that determine to be satisfactory to us
  • While we retain your vehicle we may move it anywhere
  • The parking fee continues to be owed for the period that we retain your vehicle

 

  1. ABANDONED VEHICLES
  • If you pay the parking fee upon arrival and your vehicle is left in the carpark beyond its permitted time, we may either clamp the vehicle

or move and store it at your cost

  • If you are not required to pay the parking fee until leaving the carpark and your vehicle is left in the carpark for more than 48 hours, we may either clamp the vehicle or move and store the vehicle at your cost
  • After 30 days we are entitled to sell your vehicle and its contents to pay any costs that remain outstanding

 

  1. DAMAGE
  • You are liable for any damage to the carpark caused by your vehicle, including damage caused by oil or other substances

 

  1. NO SAFE CUSTODY OF ARTICLES
  • We accept no liability for any loss or damage to any article left in our custody or control
  • Our employees are not authorised to accept any of your possessions for safe custody, except the keys to your vehicle where possession is taken at our employees request

 

  1. WHO ELSE HAS RIGHTS UNDER THIS AGREEMENT?
  • All our rights under this agreement are also for the benefit of and enforceable by our employees and agents, and the owner of the carpark, if we do not own the carpark ourselves
  • Your rights under this agreement are for your benefit only

 

  1. WAIVER
  • If we fail to act or pursue any right or remedy available to us will not in any way prejudice our right to exercise that or any other right or remedy

 

  1. WILL THESE CONDITIONS EVER CHANGE
  • We can amend any of these conditions at any time. Carpark attendants are not authorised to amend these conditions on our behalf

 

  1. OTHER AGREEMENTS
  • If there is any inconsistency between these conditions and those contained in any other written agreement which you have entered with us, the conditions contained in that agreement will prevail

 

  1. WORDS USED IN THIS AGREEMENT
  • To avoid any confusion as to the meaning of these conditions;

“claim” includes any claim for damage, loss, compensation, demand, remedy, liability or action

“costs” includes any fees, charges or costs incurred or charged by us, including GST

“damage” includes direct, indirect, consequential and special damage

“vehicle” means any motor vehicle of the kind described in clause 2 and includes accessories and contents
“we” and “us” means Christchurch Casinos Limited and includes any of its employees, agents and independent contractors

“you” means the driver of a vehicle entering this carpark

 

  1. Active Players Club Membership
  • The Players Club members rate includes complimentary parking during the operational hours of Christchurch Casino
  • To be eligible for the Players Club members rate and free parking, individuals must be active members of the Players Club
  • An active member is defined as an individual who participates in our entertainment or food and beverage options offered by Christchurch Casino
  • Christchurch Casino reserves the right to determine the status of an individual’s active membership and may request proof of participation or spending to maintain eligibility for the Players Club members rate
  • Failure to meet the requirements of an active member may result in the forfeiture of the Players Club members rate and the imposition of standard parking charges
  • Christchurch Casino reserves the right to modify or terminate the Players Club members rate and associated parking benefits at any time

 

  1. Electric Vehicles
  • The Vehicle charging bay is only available for use in conjunction with the legitimate use of the Charging Station
  • You acknowledge that our Charging Station will not be supervised and that you will use it at your own risk
  • You must not use one of our Charging Stations in a way that will put the Charging Station, you, any other person, your EV or any other person’s EV at unnecessary risk
  • You must promptly disconnect your vehicle from the Charge Station, and remove your vehicle from the vehicle charging bay, after your vehicle is charged
  • Your use of our Charging Station must be fair and reasonable, and must not be excessive
  • If, at Christchurch Casino’s discretion, we consider that your usage is unfair, unreasonable or excessive, we may immediately suspend, or restrict your access to our Charging Station to which these Terms and Conditions apply
